The Town of Kingsville’s Site Alteration By-law (64-2025) regulates how land can be altered by filling, grading, or excavation. These types of alterations can often cause drainage and flooding issues on neighboring properties.
Per By-law 64-2025, you need a Permit from the Town if:
- You plan on changing the grade of your property by more than 10cm.
- The placement or movement of soil on your property will affect how your property drains surface water to neighboring properties.
- The soil or fill material that you are importing to your property is contaminated.
- Your proposed alteration is for any reason other than landscaping or gardening.
- There is a river, creek, or drainage ditch on your property.
If any of the 5 statements above are true, you need a Permit from the Town prior to completing your proposed Site Alteration. Please fill out this form to apply for a Permit.

Fees
Payment is not required at time of application. You will be contacted for payment once your application has been reviewed. Application fees are in accordance with the current Fees and Charges By-Law.
Special Exemption from Permit
If you have a current open application with the Town of Kingsville for a Site Plan, Building Permit, Plan of Subdivision, or Consent that relates to your proposed Site Alteration, you are exempt from needing a Permit from the Town.
