CONDITIONS
THE CONSUMER will supply all water lines, pipes, fixtures and other installations on the premises and to the point of delivery, at or adjacent to the street line, the same to comply with the requirements of the American Waterworks Association and the Town of Kingsville Development Manual policy, and to be inspected by an Environmental Services Dept. Inspector before connection to the municipal water supply (Call 733-2305)
THE TOWN will use reasonable diligence in providing a regular and uninterrupted supply of potable water, but does not guarantee an uninterrupted supply, or a supply at any specific pressure, and will not be liable to the Consumer in damages for failure to supply water.
Acceptance of this application will constitute a contract binding upon the Town and the Consumer and all persons claiming through or under the Consumer, and will not be modified or affected by any oral agreement, promise or representation of any officer or employee of the Town or other person, whomever, and the vacating of the premises herein shall not release the Consumer from this contract except at the option of the Town.
Failure of remote reader apparatus shall not release the Consumer from actual accrued cost as determined by direct read of the water meter.
This contract, unless otherwise terminated by the Town under the provisions hereof, shall remain in force until the end of the year of its execution, and thereafter from year to year may be terminated by a notice of at least one month prior to any payment date described by the Town, given by either party to the other.
THE CONSUMER hereby expressly authorizes and empowers the Town at it option to cut off the supply of water and terminate this Agreement whenever any water rates or other charges hereunder are in arrears, or upon violation by the Consumer of any of the terms and conditions of this contract or of the provisions of any regulations now or hereafter made applicable hereto by the Town.
THE CONSUMER agrees to comply with all the conditions, stipulations and agreements hereto, and with all regulations of the Town now or hereafter made applicable hereto, to make a deposit in such amount as is required by the Town as a guarantee of the fulfillment of the terms hereof by the consumer, and to pay to the Town such rates for water and/or other charges, if any, as are or may be in force from time to time under authority of Resolution of the Town, and which rates may be revised from time to time; and any such Resolution and the conditions above hereto shall apply to and form part hereof. This application, when signed by the applicant and accepted by the Town, shall thereupon constitute a contract between the Consumer and the Town.
New water lines must be installed by a Contractor listed on the Approved Servicing Contractors List. Only a licenced Environmental Services Operator employed by the Town can tap into an existing municipal water line. Before backfilling, new service lines need to be inspected from the main to the property line. Appointments for inspections and taps need to be scheduled 48 hours in advance by calling 519-733-2305 and asking for the water desk.
