Fireworks Permit Application

(pursuant to By-law 102-2003, as amended by By-law 49-2013)

Applicants must apply for the permit at least two weeks prior to the event.

A permit is only valid for the date and times specified within the municipal boundaries of the Town of Kingsville.

Consumer fireworks are only permitted for use on private property.

If the person applying for the permit is not the owner of the property upon which the fireworks display will be located, written consent of the owner must be obtained.

Persons applying for a permit to discharge consumer fireworks must be at least 19 years of age.

In consideration of the Town of Kingsville issuing a Fireworks Permit, the applicant covenants and agrees to waive, indemnify and holdharmless the Town of Kingsville and its elected officials, employees, servants, agents, and successors from and against any and all manner of actions or causes of action, damages, costs, loss or expenses of whatever kind (including, without limitation, legal fees) which the Town of Kingsville or its elected officials, employees, servants, agents, and successors may sustain, incur, or be put to be reason of or arising out of:

  1. issuance of this permit;
  2. the fireworks display, including, without limitation, the handling, storage, firing, setting off, exploding or other use of fireworks in connection therewith;
  3. the applicant’s use or occupation of the location upon which the fireworks display is to occur; or
  4. any act or omission of the applicant or any person for whom the Applicant is at law, responsible, including, without limitation, the non-observance or non-performance of any obligation imposed by federal or provincial law.

In order for your application to be reviewed, it must be submitted at least two (2) weeks prior to the event or activity and include:

  1. This completed application form.
  2. A copy of the site plan that is no larger than legal size (i.e. 8.5x14")
  3. $100 Fireworks Permit fee, payable by cash or debit.  No personal cheques or credit cards are accepted.  This fee is non-refundable.
  4. Written consent of the registered owner of the property (if applicable)

Note: An inspection of the proposed site may be required prior to issuing the permit.  Additional precautions may be required after an assessment by the Fire Inspector prior to issuing the Fireworks Permit.

By submitting this application for this permit, the Applicant shall at all times observe and comply with, and endeavour to ensure strict observance of and compliance with, all statutory requirements, rules, regulations, by-laws, terms and conditions, or other authority which in any manner affect or related to this permit, including without limitation, the by-laws of the Town of Kingsville.

If approved, the following terms and conditions must be followed:

  1. No sound or construction equipment other than the equipment approved under the permit can be used by the applicant.
  2. The event or activity is restricted to the approved location and details in the permit.
  3. One or more persons are required to be onsite supervising throughout the duration of the event and are responsible to ensure compliance with the permit's terms.
  4. The permit issued is not transferable.
